JOHN HEWITT OF BATIMBURHS

In the name of God Amen,I JOHN HEWITT of Batimburhs in the Parish of Kirk Andrews on Eske of County of Cumberland ,being weak in body but of sound and perfect mind and memory.Blessed be to Almighty God for the same,do make and publish this my last will and testament in manner and form following,that is to say,First I give and bequeath unto my son in law ANDREW LITTLE the sum of four pounds.I do also give and bequeath to my son in law JOHN IRWING the sum of three pounds.I also give and bequeath unto my daughter ELIZABETH HEWITT the sum of twelve pounds.I also give and bequeath unto my son GEORGE HEWITT the sum of seven pounds.I also will and order my executor to pay to my eldest son CHRISTOPHER HEWITT the sum of fifteen pounds,for which sum with other consideration he agreed to discharge a debt of thirty pounds which he was jointly concerned in agreement I notified to RICHARD BATY of Battimburh and ROBERT of Staggmire as witness to the same.Which said several legacies or sum of money I will and order shall be paid out of my effects to the said respective legatees within twelve months after my decease and wife,s.My wife to have the use of the said effects during her natural life.But in case my effects shall fall short in paying the aforesaid legacies or sum above specified,then I order proportional deductions to be made in the legacies bequeathed to my two son on laws ANDREW LITTL:E and JOHN IRWING,but on the contrary if my effects shall exceed the several said legacies or sum then I will order the over plus to be equally divided between my son GEORGE HEWITT and my daughter ELIZABETH HEWITT aforesaid whom I ordain and constitute and appoint executors of this my last will and testament,hereby revoking all former wills by me made.In witness whereof I have hereunto set my hand and seal this twenty fourth day of April in the year of our Lord 1741.
